Extending Your Stamp 1G Permission: What You Need to Know

If your Stamp 1G is nearing expiry or has expired for less than six months and you have already reached your limit under the Third Level Graduate Programme, you may still be able to apply for a short-term extension in certain situations. These extensions are discretionary, case-by-case and subject to strict criteria set by the Irish Immigration Service Delivery (ISD), Department of Justice, Ireland.

🛂 Who Can Apply for a Stamp 1G Extension?

You may be eligible if any of the following apply:

  1. You have a job but are still awaiting your permit:
You have obtained an offer of employment and have submitted, or are in the process of submitting, a work permit application. Processing delays, refusals requiring reapplication, or employer sponsorship timelines mean your Stamp 1G is close to expiry while the employment permit process remains ongoing.
  2. You have experienced medical challenges:
  3. A critical illness or significant injury during your Stamp 1G period resulted in your inability to fully utilise your permission, limiting your capacity to seek employment or commence permitted work, and necessitating additional time to recover and progress your employment plans.
  4. You have encountered compassionate or personal difficulties: Exceptional personal circumstances, such as bereavement, family emergencies, or other serious situations beyond your control, have affected your capacity to fully utilise your permission, secure employment, or complete your transition to a work permit. Financial pressures linked to educational loans or a dependent family whose livelihood hinges on your income may also be considered as part of compassionate grounds.
  5. Other exceptional circumstances may apply, but applications on these grounds face a notably high refusal rate.

🗂️ Mandatory Documents

To apply for a Stamp 1G extension, you will need to submit the following:

  1. Biometric page of your current in‑date passport

  2. Last three months’ payslips or bank statements

  3. A copy of your landing stamp

  4. Front and back copy of your current IRP card

  5. Additional supporting documents

    • These depend on the basis of your extension request, for example:

      • Employment permit application proof

      • Job application records

      • Medical proof if out of work due to illness

      • Evidence of educational loan repayment

🗓️ When Should You Apply?

Timing is crucial. You should apply for an extension at least 10 weeks before your current Stamp 1G expires. Applying too soon may not be accepted, and applying too late could leave you without legal residency status in Ireland.

The "Extension of Student Conditions" application form can be found on the ISD Online dashboard.

Processing Times & Right to Work?

Once submitted, your application can take up to 4 to 6 months to be processed. If approved, the Department of Justice will issue a letter confirming the length of your extension, which could be 6 months or, in rare cases, 12 months.

Applicants are not permitted to work while their Extension of Student Conditions application is under consideration. The issue has recently been highlighted in national news coverage, drawing attention to the impact on students’ right to work during the processing period. 📡 Track Application

The Digital Contact Centre is a self-service portal introduced by the Department of Justice on 24 October 2024. It allows immigration applicants to manage key aspects of their interactions with the system without needing to contact the department by phone. The platform supports:

  • Checking the real-time status of existing applications.

  • Accessing application updates through a centralised online dashboard.

  • Navigating to relevant immigration forms and guidance.

Applicants can check their status and access the portal using the following link: https://portal.irishimmigration.ie/en/

⚖️ Employment Permits Without a Valid IRP Card

A noteworthy High Court judgment in P v Minister for Business, Enterprise and Innovation (2021) confirmed that the Minister for Department of Enterprise, Trade and Employment retains discretion to grant an employment permit even where the applicant does not hold a valid immigration permission. This builds on Ling and Yip Limited v Minister for Business, Enterprise and Innovation (2018), which affirmed that Section 12(1)(i) of the Employment Permits Act 2006 allows for such discretion. The Court found that refusing a General Employment Permit solely due to immigration status, without properly considering discretion, was legally flawed.

This judgment sets a precedent, but the application of such discretion is very rare and narrowly drawn.

The High Court in Singh v. Minister for Enterprise, Trade and Employment [2025] IEHC 383 held that Section 12(1)(i) of the Employment Permits Act 2006 (the Act) provides the Minister with the power to refuse employment permits to undocumented workers. The judgment states that the Minister cannot categorically deny permission to applicants on the basis of their status; however, they can refuse permits if the applicant does not provide them with extenuating circumstances or information on the applicant's efforts to regularise their situation. It is not a standard route, and applicants are urged to have valid immigration permission wherever possible.

📌 Final Thoughts

The Extension of Student Conditions (ESTC) remains an important mechanism for many non-EEA graduates and jobseekers in Ireland, providing additional time where individuals are awaiting employment permit decisions, progressing applications, or dealing with exceptional circumstances such as illness. In light of the strict approach to immigration compliance and the limited, case-specific discretion available in employment permit matters, maintaining lawful status is essential, and the ESTC can also serve as evidence that appropriate steps were taken to regularise residence.
